General Terms and Conditions

1. Contractual partner

On the basis of these General Terms and Conditions (GTC), a contract is concluded between the customer and

hereinafter referred to as the provider, the contract is concluded.

2. Subject matter of the contract

The subject matter of the contract for my online store is

  1. The sale of digital products, e.g. color passes. The specific digital products offered can be found on our product pages.
  2. The provision of services in the form of courses. The specific services offered can be found on our product pages.

The main features of the digital products and services can be found in the item description.

The sale of digital products is subject to the restrictions set out in the product description or otherwise resulting from the circumstances, in particular with regard to hardware and/or software requirements for the target environment. Unless expressly agreed otherwise, the subject matter of the contract is only the private use of the products without the right to resell or sublicense.

3. Conclusion of contract

The presentation of goods and services in the online store does not constitute a legally binding offer, but a non-binding online catalog. You can initially select my goods and services without obligation or place them in the shopping cart and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the order process. You place a binding order for the goods or services contained in the shopping cart by pressing the “Buy now” button.

Confirmation of receipt of your order will be sent by e-mail immediately after the order has been sent.

When the contract with me is concluded depends on the payment method you have selected in the online store:
PayPal, PayPal+ (direct debit or credit card via PayPal): During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction. This concludes the contract with me.

4. Duration of the contract

The contract is concluded for an indefinite period.

5. Reservations

The provider reserves the right not to provide the promised service if it is not available.

6. Prices

The prices quoted in the store include statutory VAT and other price components.

7. Terms of payment

The customer only has the following payment options in the online store: payment service provider PayPal, direct debit and credit card as part of PayPal+. Other payment methods are not offered and will be rejected.

PayPal and direct debit or credit card via PayPal+: When using PayPal+, PayPal enables the provider and customer to process the payment between themselves. PayPal forwards the customer’s payment to the provider. Further information can be found on the PayPal website.

8. Warranty

The supplier is granted the right to choose between repair or replacement in the event of subsequent performance if the goods are new and the customer is an entrepreneur. This does not apply to claims for damages of the customer due to injury to life, body, health or essential contractual obligations, which must necessarily be fulfilled in order to achieve the contractual objective. This also does not apply to claims for damages due to grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agent. In all other respects, the statutory provisions shall apply.

9. Vertragsgestaltung

Der Kunde kann Fehler in der Eingabe während des Bestellvorganges korrigieren. Hierzu kann er folgendermaßen vorgehen: Nutzen des “Zurück”-Buttons, Nutzen der Buttons “Buchung stornieren” oder “Umbuchen” (auch durch Link in Bestätigungs-Email erreichbar). Um Bestellungen zu ändern: betätigen des “Löschen”-Buttons und Anzahl-Änderung im Einkaufswagen.

10. Exclusion of liability

Claims for damages by the customer are excluded, unless otherwise stated in the following. This also applies to the provider’s representatives and vicarious agents if the customer asserts claims for damages against them. Excluded are claims for damages by the customer due to injury to life, limb, health or essential contractual obligations, which must necessarily be fulfilled in order to achieve the contractual objective. This also does not apply to claims for damages due to grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agent.

11. Prohibition of assignment and pledging

Claims or rights of the customer against the provider may not be assigned or pledged without the provider’s consent, unless the customer has demonstrated a legitimate interest in the assignment or pledge.

12. Language, place of jurisdiction and applicable law

The contract is drawn up in German. The further execution of the contractual relationship shall be in German. The law of the Federal Republic of Germany shall apply exclusively. For consumers, this only applies insofar as no statutory provisions of the country in which the customer is domiciled or habitually resident are restricted.

13. Severability clause

The invalidity of any provision of these GTC shall not affect the validity of the remaining provisions.

Alternative dispute resolution in accordance with Art. 14 para. 1 ODR-VO and § 36 VSBG:

The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
